INCORPORATED VILLAGE OF MASSAPEQUA PARK NASSAU COUNTY, NEW YORK NOTICE IS HEREBY GIVEN pursuant to the provision of the State of New York, that a Public Hearing will be held by the Zoning Board of Appeals in the Incorporated Village of Massapequa Park on Wednesday, July 20, 2022, at 8:00 PM in the Village Hall, 151 Front Street, Massapequa Park, New York 11762 for the following purposes: Case No. 4332 To consider the variance application of Mr. and Mrs. Keith Irving, 321 Philadelphia Avenue, Massapequa Park, NY 11762 to maintain the following: pool pavers, waterfall, gazebo, and emergency escape rescue opening ALL in violation of Village Code. Also, no portion of a pool including walkways, pump, filters, showers, accessories, or pool water disinfectants shall be located at a distance less than five (5) feet from any side or rear property line or building setback line. The waterfall is located three point nine (3.9) feet to east rear property line with a zero (0) foot setback. The pavers behind the waterfall go right to rear property line with a zero (0) foot setback. Remaining pavers are located two point nine (2.9) feet from east and south property lines. Chapter 345-31 Rear and Side Yards which states: Must maintain a five (5) foot side yard and a 15 foot rear yard setback to all structures. Gazebo is located at its closest point three point one (3.1) feet from side property line and 11.9 feet from rear property line, deficient by one point nine (1.9) feet and three point one (3.1) feet, respectively. Emergency escape rescue opening well is located two point eight (2.8) feet from south property line, deficient by two point two (2.2) feet. Case No. 4336 To consider the variance application of Mr. and Mrs. Timothy Radomski, 156 Atlantic Avenue, Massapequa Park, NY 11762 to replace a non-permitted central air- conditioning condenser without the required side yard setback in violation of Village Code. Such proposal is in violation of Village Code Chapter 345-31 Rear and Side Yards which states: Must maintain a five (5) foot side yard setback. Existing condenser is located approximately three (3) feet to south side property line. Case No. 4339 To consider the variance application of Mr. and Mrs. Dennis Tranchina, 230 Von Huenfeld Street, Massapequa Park, NY 11762 to erect a front addition and front porch in violation of Village Code. Such proposals are in violation of the following Village Codes: Chapter 345-30 (A) Front Yards which states: Minimum front yard setback must be 25 feet required. Proposed front addition to be located 20.3 feet from front property line. Deficient by four point seven (4.7) feet. Chapter 345-30 (D2) Permitted Structures in Front Yards which states: A covered porch may encroach five (5) feet into the 25 foot front yard setback and cannot have a width greater than the width of the house to which its attached. Proposed front porch to encroach eight (8) feet into the front yard leaving a setback of (17) feet to north property line. Proposed porch at its furthest roof projection is located 15.3 feet to front property line. Case No. 4340 To consider the variance application of Mr. Shawn Kildare, 97 Aster Street, Massapequa Park, NY 11762 to erect an inground pool, pool equipment and central air conditioning unit and to maintain a rear yard deck ALL in violation of Village Code. Such proposals are in violation of the following Village Codes: Chapter 345-41 (H, J) Pools, Walkways, Distances which states: An unobstructed walk area of not less than 24 inches wide shall be provided to extend entirely around pools below grade. Proposed pool to be located two (2) feet forward of east foundation and have a setback of five (5) feet to rear north property line and three (3) feet to existing six (6) foot fence at its shortest point and increases setback as you go south. Walkway to be three (3) feet with two feet of pervious area, same for east side except for the northeast portion where only have three (3) foot walkway. Chapter 345-30 (D) Permitted Structures in Front Yards which states: The following items are permissible encroachments; a porch, portico, emergency egress window well and a temporary storage container. Proposed pool equipment and existing central air conditioning condenser to be located in front of east foundation. Chapter 345-30 (A) Front yards which states: Minimum front yard setback must be 25 feet. Existing deck approximately three quarters (3/4) of deck is less than the 25 feet and proposed inground pool to be at its worst approximately eleven (11) feet from east property line.
